1. Introduction

Welcome to Home Showings ("Platform," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our online real estate platform, which connects real estate agents ("Requesting Agents") with licensed showing agents ("Showing Agents") to facilitate home showings for prospective buyers and renters. By using the Platform, you agree to comply with and be bound by these Terms. If you do not agree, you may not use the Platform.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years old.
  • Be a licensed real estate professional in your jurisdiction.
  • Provide accurate and up-to-date information when registering.
  • Comply with all applicable real estate laws and regulations.

3. Services Provided

The Platform allows:

  • Requesting Agents to post home showing requests and pay Showing Agents for their services.
  • Showing Agents to accept showing requests and receive payment through the Platform.
  • Secure communication between users regarding showing logistics.

4. User Responsibilities

4.1 Requesting Agents

  • Must ensure showing requests comply with all local laws and regulations.
  • Are responsible for payment to the Showing Agent for completed services.
  • Must provide accurate property details, access information, and any necessary permissions.

4.2 Showing Agents

  • Must be legally authorized to conduct home showings.
  • Are responsible for completing accepted showings professionally and on time.
  • Must respect property access rules and any instructions provided by the Requesting Agent.

5. Payments & Fees

  • Requesting Agents must pay Showing Agents the agreed-upon fee through the Platform.
  • The Platform may charge a service fee for facilitating transactions.
  • Payments are processed securely via third-party payment processors, and users agree to their terms.
  • The Platform is not responsible for any payment disputes between users.

6. Cancellations & Refunds

  • Requesting Agents may cancel requests per the cancellation policy outlined in their booking.
  • Showing Agents who fail to fulfill an accepted request may be subject to penalties, including removal from the Platform.
  • Refunds, if applicable, will be processed per the Platform's refund policy.

7. Compliance with Laws

All users agree to comply with federal, state, and local real estate laws, including fair housing regulations and licensing requirements. The Platform does not provide legal, real estate, or brokerage services and is not responsible for users' legal compliance.

8. User Conduct

Users agree not to:

  • Misrepresent themselves or their qualifications.
  • Engage in fraudulent, misleading, or unethical practices.
  • Share or misuse confidential information obtained through the Platform.
  • Use the Platform for any illegal or unauthorized purposes.

9. Platform Limitations & Disclaimers

  • The Platform provides a marketplace for connecting agents and does not guarantee the performance, conduct, or reliability of any user.
  • We are not responsible for any disputes, damages, or liabilities arising from transactions between users.
  • The Platform is provided "as is" without warranties of any kind.

10. Limitation of Liability

To the maximum extent permitted by law, Home Showings is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or reputational harm, arising from the use of the Platform.

11. Termination & Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activities.

12. Modifications to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by the laws of California. Any disputes shall be resolved in the courts of California.
